Search Burke County Civil Court Dockets

Need a Burke County civil case? Start with the Burke County clerk, the office that keeps the underlying court records. A Burke County civil court dockets lookup can surface a filing, a hearing date, or a recorded status, though it never replaces the official court file itself. Civil suits, small claims, estates, and similar matters all move through the unified trial-court system, and the level that handles a case depends on its type and jurisdiction. Online results are a helpful first stop. Still, the clerk of court holds the true record, and any docket search simply points you toward it.

Burke Civil Portal Filters

Burke County entered the statewide eCourts system on October 13, 2025. The Portal is the public window into Enterprise Justice, known to many as Odyssey. It is separate from File & Serve, which handles electronic filing. For civil searches, the filters that earn their keep are location, case type, case status, a filing-date range, and party criteria. Remember that no filter runs a search by itself. It only refines the required name or number query.

Civil status options you may see include Pending, Appealed, Reopened, Stayed, Transfer to Another County, Transferred to Superior Court, Trial De Novo, Small Claims Appeal, and assorted Disposed - labels. Each one describes system status. It does not settle the legal meaning of the case. Common surnames in a Burke County search respond well to a date range plus the location filter, though the public display hides the month and day of birth.

The Judicial Branch Portal training materials walk through the shared public search and its access limits. Registering an account lets you save cases. It does not grant elevated access to anything restricted.

Civil Dockets: What They Show

Open a Burke County civil Case Summary and you may find Case Information, Assignment Information, Party Information, Causes of Action, Case Events, Dispositions, Hearings, Financial Information, and public documents where they exist. Cases rarely show every block. The one section unique to civil work is Causes of Action, which Portal flags for civil, family, probate, and mental-health categories. It tells you what kind of proceeding you are reading. The dated events, meanwhile, lay out the procedural sequence in order.

Record numberThe Enterprise Justice year, case-type, sequence, and county-identifier format; use the number printed on the court document.
Assignment informationCourt or assignment data when recorded for the Burke County civil case.
PartiesThe public party block; the official generic guide does not support inventing side labels from a case not inspected.
Causes of actionThe civil, family, probate, or mental-health classification block described in Portal materials.
Case eventsThe chronological public record of filings, orders, notices, settings, and other docketable activity.
Dispositions and hearingsSections that appear when data exists; Search Hearings is the current-date tool.

Where public documents exist, you download them one at a time. A docket event on screen does not guarantee its image is public or downloadable.

Burke Civil Docket Court Levels

Not every Burke County civil case lands in Superior Court. The main dividing line is $25,000. Superior Court takes civil actions above that figure. District Court generally handles those at or below it, subject to case-type rules. Magistrate small claims sit in a narrower lower layer. Estates, guardianships, foreclosures, and similar special proceedings are clerk-managed categories. They sit within the same Burke County Clerk and Portal environment.

The District Court jurisdiction statute sets out the lower-court rules behind Burke County civil docket searches.

That jurisdictional split is why a Burke County case number deserves context. Read it with its category and court history rather than assuming one division holds every civil matter.

What Cases Fill the Civil Docket

What shows up in Burke County civil searches? The list runs from ordinary civil actions, small claims, and estates to nonconfidential special proceedings and civil foreclosures. Bond forfeitures, confession-of-judgment matters, non-domestic restraining orders, and domestic filing categories round it out. Portal's taxonomy also tags cases as Civil General, Civil Magistrate, or Civil Superior. Trust the category the result or clerk document actually displays. Never assume a civil label means a contract lawsuit.

For estates, guardianships, and foreclosures, the Burke County Clerk is still the local record keeper. The Register of Deeds plays a different role and does not maintain court dockets. A Portal result points you toward the right public case record. Need certified copies? The clerk is the local source. The same goes for a public file that never made it fully online.

Burke Civil Docket Movement

Some Burke County civil status labels track movement, not outcomes. Transferred to Superior Court means the trial division changed. Transfer to Another County means the record now lives elsewhere. Trial De Novo signals a fresh trial rather than review of the prior record alone, and Small Claims Appeal marks an appeal out of the magistrate layer. Once a movement label appears, confirm the current setting with the receiving court or county.

Pending
The Portal taxonomy has not recorded a final disposition for the civil case.
Stayed
The displayed status indicates the case is paused; the dated case events give the practical context.
Disposed - Final Judgment No Trial
A published Portal civil status label for a final judgment without a trial.
Disposed - Voluntary Dismissal
A published Portal status label that records a voluntary dismissal, not a generic finding about every related claim.

Note: A transfer or an appeal entry just points you toward the newer case file. It does not explain why the Burke County matter moved courts.

Hearings on the Civil Docket

Hearing dates shift often in Burke County. A docket entry from the past is history, not a promise. Before you plan around any date, run Portal Search Hearings. The tool wants a Burke location, a hearing type, a search type, and the matching input. You can look up a case number or a party. A business, an attorney by name or bar number, a judicial officer, and a courtroom all work too. Any text search runs inside a date-from and date-to window.

For dates, start with the Burke County contact directory. It routes questions by date. It also links the official Civil Calendars. A posted calendar shows the published view. The Case Summary and Search Hearings tools may carry newer information, since settings can change after a calendar goes up. When a date looks shaky, work the chain: Portal Search Hearings first, then the Case Summary Hearings block, then the Burke civil calendar, then the right court office, then the Clerk at (828) 433-3200.

Burke Civil Calendar Sources

Two tools, two jobs. Burke County's official court-calendar service publishes calendars built around a court session or a date. The Portal Register of Actions holds the full case history. Search Hearings sits in between as the live lookup tool. Why the split matters: a current hearing can move after a calendar is posted. A case-specific check beats trusting a printed calendar alone.

Court level matters too. The official Superior Court source describes the trial division that handles Burke County civil actions above the main jurisdiction threshold.

The page makes the point plainly: filter by court level in a Burke County civil docket search, even though the same statewide Portal opens the public search for every division.

Who Can See Civil Dockets

Civil dockets in Burke County are public by default. When a case and its material are public, anyone can open a Case Summary through the Portal. The Burke Clerk's public terminal goes further. It covers civil, special-proceeding, and estate information. At the counter, you may inspect a public electronic or paper case file in the county where it is kept, subject to access limits. For procedural routing, call the Burke County Clerk at (828) 433-3200; the office can point you to the right file or copy channel.

Public-access baseline:

G.S. 7A-109 makes the clerk responsible for court records and generally allows public inspection during regular office hours unless law prohibits access.

G.S. 132-6.2 addresses inspection and copies of existing public records but does not require an agency to create or compile a new record.

Registration alone does not unlock sealed or restricted material. The Portal copy is also not the official record. For a public Burke County civil docket entry that never made it online, the clerk's terminal, counter, phone line, and request process form the documented chain of access.

Burke Civil Files at the Clerk

Civil case files sit with the Burke County Clerk of Superior Court, the official custodian behind any public docket. Know the case number and the document you want. Then ask the clerk to confirm the service, the total cost, and the timing before you call or visit. State law sets the fees. The charges are $2 to prepare the first page, $0.25 for each additional page, $3 for a clerk-seal certificate, and $10 for an exemplification. These are separate services. Do not assume one all-in certified-copy price.

The Burke County courthouse stands at 201 South Green Street in Morganton. Its clerk counter, public terminal, and file-inspection route are the local alternatives to Portal. The official Burke County courthouse page posts the address and access point.

Before requesting a file, run a civil case lookup. Use the county's Docket Search route with the Burke County location filter selected.
